Terms of Use

These terms govern your use of the mobile applications made by Merius ("we", "us"), each referred to as "an app". The sections below apply to every app; app-specific terms at the end add details that only apply to a particular app. By downloading or using an app, you agree to them.

If you downloaded an app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If the two conflict, these terms apply to the extent the law and Apple's rules allow.

Using the apps

We grant you a personal, non-exclusive, non-transferable licence to use each app on devices you own or control, for your own personal or internal business use. You must be at least 13 years old (or the minimum age in your country) to use an app.

Accounts

Some apps let you create an account; others work without one. Where an app has an account, you are responsible for keeping your login credentials safe and for activity under your account, and you can delete the account from within the app at any time.

Purchases and subscriptions

• Paid features are sold through your Apple ID as auto-renewing subscriptions or one-time purchases. Prices, billing periods and what each plan includes are shown in the app before you buy.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel them in your Apple ID settings.
• If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
• A one-time ("lifetime") purchase unlocks the features described at the time of purchase for as long as the app is offered and supports your device.
• Refunds are handled by Apple under Apple's terms.

Your content

Everything you create or bring into an app (notes, drawings, recordings, documents, photos) remains yours. You grant us only the limited rights needed to run the app's features for you, as described in our Privacy Policy. You are responsible for making sure you have the right to use content you import or upload, and for keeping your own backups of anything important.

AI features

Some apps include features powered by AI or machine learning, such as analysis, handwriting recognition, transcription, summaries or generated images. This output can be incomplete or wrong. Treat it as a starting point and check anything that matters before relying on it.

Acceptable use

You agree not to misuse the apps: no attempts to circumvent paid features or usage limits, reverse-engineer, probe or disrupt our services, upload or share content you have no right to use, or use an app for anything unlawful.

Third-party services

Apps may rely on or link to services we do not operate (for example Apple iCloud, or websites you open from within an app). Those services are governed by their own terms, and we are not responsible for them.

Disclaimer and liability

The apps are provided "as is". We work to keep them reliable, but we do not warrant uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect or consequential losses, including lost data, and our total liability is limited to the amount you paid for the app concerned in the twelve months before the claim. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.

Ending your use

You can stop using an app at any time by deleting it. We may suspend access for anyone who breaches these terms, and we may discontinue an app; where possible, we will give notice and a way to export your content first.

Changes

We may update these terms as our apps evolve. Material changes will be reflected on this page with an updated date; continued use after a change means you accept the updated terms.

App-specific terms

Nartie

• What it does. Nartie provides AI-assisted features such as nail analysis, virtual try-on previews, care routines and progress tracking. Results are previews and suggestions, not guarantees: a try-on image shows an approximation of a design on your hand, and analysis results are general guidance.
• Not medical advice. Nothing in Nartie is a medical diagnosis or medical advice. Analysis results are for general cosmetic guidance only. See a healthcare professional about anything that worries you.
• Account. Nartie requires an account. You can delete it at any time from the Profile screen, which permanently removes your data.
• Monthly allowances. Every plan, including paid plans, includes a stated monthly allowance of AI-generated results (for example, analyses and try-ons). Allowances are listed in the app and reset at the start of each calendar month. Unused allowance does not carry over.

Heednote

• No account. Heednote works without an account. Your notebooks live on your device and, if iCloud is on, in your own private iCloud storage.
• Free and Pro. The free version has a limit on the number of notebooks and some features; Heednote Pro removes the limits. Reading, searching, exporting and backing up your notes are never locked behind a purchase.
• Recordings. You are responsible for having permission to record lectures, meetings or anyone else's voice where the law or the venue requires it.
• Recognition and transcription. Handwriting recognition, text recognition and transcription run on your device and can contain mistakes; check important text against the original.
